Welcome to Dialed Outdoors. These Terms of Service ("Terms") govern your use of dialedoutdoors.com (the "Site") and any purchase you make from us. By accessing the Site or purchasing our products, you agree to be bound by these Terms.

About Us

The Site is operated by Dialed Outdoors LLC, a Washington limited liability company ("Dialed Outdoors," "we," "us," "our"), located at 2520 E McGraw Street, Seattle, WA 98112.

Eligibility

By using the Site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province and have given us consent to allow any minor dependents to use this Site.

You may not use our products for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction (including but not limited to copyright laws) in your use of the Site.

Products and Availability

We reserve the right, at any time, to modify, suspend, or discontinue any product or service without notice. We reserve the right to refuse service to anyone, for any reason, at any time. We are not liable to you or any third party for any modification, suspension, or discontinuation of any product or service.

Product colors, features, and specifications may vary slightly from photos or descriptions due to lighting, monitor calibration, or manufacturing variance. We describe our products as accurately as possible.

Founder's Series products are limited-quantity releases. Once sold out, restocks are not guaranteed.

Orders and Pricing

All prices are in United States Dollars (USD) unless otherwise noted. Prices are subject to change without notice. Shipping and applicable sales tax are calculated at checkout.

We reserve the right to refuse or cancel any order, including but not limited to orders that appear to be placed by resellers, bots, or fraudulent purchasers, or orders where the price was displayed incorrectly due to a technical error.

Once an order is placed, you'll receive an order confirmation email. This email is an acknowledgment of your order, not an acceptance. Your order is accepted when we ship it and send you tracking information.

Payment

We accept payment through Shopify Payments (which processes major credit and debit cards, Shop Pay, Apple Pay, and Google Pay), PayPal, and other methods displayed at checkout. All payment information is processed securely by our payment providers; we do not store your full credit card details on our servers.

By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge your payment method for the total amount of your order.

Shipping and Returns

Shipping terms are set forth in our Shipping Policy. Return and refund terms are set forth in our Refund Policy. Both are incorporated by reference into these Terms.

Intellectual Property

All content on the Site — including but not limited to the Dialed Outdoors name, logo, product designs, embroidered marks, photography, product descriptions, brand tag lines (including but not limited to "Field Tested. Dialed Approved.," "Get Dialed. Go Further.," and "Founder's Series"), and all associated trademarks — is the property of Dialed Outdoors LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Site without our prior written consent, except that you may temporarily store one copy of Site content for the purpose of viewing on your personal device.

Unauthorized commercial use of Dialed Outdoors trademarks or trade dress is a violation of these Terms and may result in legal action.

User Content

If you submit content to the Site (product reviews, photos tagged @dialedoutdoors, comments, testimonials, or other materials), you grant Dialed Outdoors a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, adapt, publish, translate, distribute, and display such content in any media, including for marketing purposes. You represent that you own or control all rights to the content you submit.

We do not review all user content in advance and are not responsible for content submitted by users. We reserve the right to remove any content at our discretion.

Disclaimers

The Site and products are provided "as is" and "as available." To the fullest extent permitted by law, Dialed Outdoors disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Our products are designed for outdoor recreational use. You use them at your own risk. Outdoor activities carry inherent risks. Dialed Outdoors is not responsible for injury, loss, or damage resulting from your use of our products in any activity.

Limitation of Liability

To the fullest extent permitted by law, Dialed Outdoors, its officers, members, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Site or products; (b) any unauthorized access to or use of our servers or personal information stored therein; or (c) any errors or omissions in content.

In no event shall Dialed Outdoors's total liability to you for all claims exceed the amount you paid to us in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, so the above limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Dialed Outdoors and its officers, members, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

Governing Law

These Terms are governed by the laws of the State of Washington, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in King County, Washington.

Dispute Resolution

Before filing any legal action, you agree to first contact us at hello@dialedoutdoors.com to attempt to resolve any dispute informally. If we cannot resolve the dispute informally within 60 days, either party may pursue formal resolution.

For claims exceeding the small claims court limit in your jurisdiction, disputes will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, held in King County, Washington. You waive any right to a jury trial or to participate in a class action for such claims.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Changes to These Terms

We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top of this page. Your continued use of the Site after changes constitutes acceptance of the updated Terms.

Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, constitute the entire agreement between you and Dialed Outdoors regarding your use of the Site and any purchase.
